올해 초 아이들에게 1억원씩 쯤 현금 증여를 하고 한국에 증여세를 냈어요. 

그걸로 바로 비상장주식 유상증자에 참여시켰습니다.

세가지 질문이 있는데요. 좀 전문(회계사 영역)일 수도 있습니다.
 

The following are not considered financial accounts:

Stocks, bonds, or similar financial instruments held directly by the person.

Real estate or an account holding solely real estate (such as, Mexican "fideicomiso" ).

A safety deposit box.

Note: A reportable account may exist where the financial institution providing the safety deposit box has access to the contents and can dispose of the contents upon instruction from, or prearrangement with, the person.

Precious metals, precious stones, or jewels held directly by the person.

Note: 31 USC 5311, Declaration of Purpose, defines "financial agency" as "a person acting for a person as a financial institution, bailee, depository trustee, or agent, or acting in a similar way related to money, credit, securities, gold, or a transaction in money, credit, securities, or gold" . Therefore, a reportable account relationship may exist where a foreign agency holds precious metals on deposit or provides insurance or other services as an agent of the person owning the precious metals.

 여기서 directly 라는 뜻은 paper 상태 즉 실물 종이 권리증을 금고에 넣어 놓고 있는 것을 말하나요?
아니면 증권사 계좌에 들어 있는 것도 directly 인가요?

1. 할아버지가 가지고 있던 해당 회사의 '주식' 이 아닌 그 주식으로 전환 가능한 채권

을 아이들에게 증여 의도로 올 중순 쯤 이체했다가 아닌 듯 해서 withdraw 철회하여 다시 돌려 드렸습니다만,

잠시나마 들어 왔었습니다. 그 채권은 default 상태여서 (이자를 지급하지 못하고 있었음)

fair value 하면 face value (액면)가 보다는 확실히 낮을 겁니다. 그런데 한편으로 accrued interests

(정상 이자 및 연체 이자)는 채권에 딸려 있습니다 받을 확률이 낮아서 그렇지만요.

이러한 default 된 exchangeable bond 의 경우 평가가 매우 곤란한데, 어떻게 반영해야 할까요?

2. 아이들 주식도 1년간 보호예수라서 어차피 팔 수는 없는데, 장외가격이 연중 1800원 ~ 3800원 정도로

움직였었는데, 연초 유증은 2500원/주 로 받았습니다. 비상장주식은 FBAR 보고에 포함시킨다

안시킨다 등의 두가지 의견이 있는 것 같은데 뭐가 맞습니까? 아이들 증권계좌에 들어가는 있습니다.

포함을 안시킨다고 하면 (1)번의 잠시 들어왔다 나간 교환사채의 밸류를 아주 크게 잡더라도

100,000 USD 가 넘은 적이 없게 되므로 보고 의무가 없거든요.

3. FBAR 홈페이지에서 web 입력을 하는 경우 아이들 대신 부모가 해 줘도 괜찮나요?
